Son claiming that father gifted 50% of the business to him

1. Question:-

My brother claims that my father gifted his (my father’s) 50% share of the business to him during his lifetime. None of the family members are aware of it. How should the matter be resolved since my father is now deceased?

Answer:-

In the queried scenario, your brother claims that your father gave his portion of the business to him which the rest of the family seems to deny. Your brother is required to produce witnesses (either 2 males, or 1 male and two females) to substantiate his claim. If he is unable to produce the required witnesses, then you (as the denier of the transaction) will be required to take a Qasm, that your father did not gift his 50% of the business to him (your brother).

On completion of the above procedure, the portion belonging to your late father will form part of his estate and be distributed in accordance to the Shari’ee law of succession.

فریق ثانی : دلیل خان  – مدعی علیہ

دعوی بابت حصہ مکان  ؛  مدعیہ اس حصہ کا حمید  خان کی طرف سے ہبہ ہونے کا دعوی کرتی ہے اور دلیل خان اس سے انکاری ہے –

فیصلہ

چونکہ مدعیہ کے گواہاں  حسب  اعتراف نہ تھے تو   مدعیہ اس  مدعی علیہ کے قسم پر راضی ہوگئ اور  مدعیہ نے  مدعی علیہ دلیل خان   کع قسم دی ؛ پس اس بناء پر مدعیہ کے خلاف فیصلہ کیا گیا

وَإِنْ لم يَكُنْ لِلْمُدَّعِي بَيِّنَةٌ حَلَّفَ الْقَاضِي الْمُدَّعَى عليه بِطَلَبِ الْمُدَّعِي لِقَوْلِهِ عليه السَّلَامُ لِلْمُدَّعِي أَلَكَ بَيِّنَةٌ فقال لَا

فقال لَك يَمِينُهُ    البحر الرائق ص307 ج7 كتاب الدعوي

أحد أسباب الحكم  اليمين و أو النكول عنه أيضا وهو أنه إذا أظهر المدعي العجز عن إثبات دعواه  فيحلف المدعي عليه  بطلبه (شرح المجلة ص394 ج5 المادة 1742
