A child passing the Meeqaat without Ihraam

Sep 12, 2023 | Hajj

QUESTION:

Do we need to pay Damm for childred aged 10, 7, 4, as they tied Ihraam in Masjidul Ayesha?

ANSWER:

In principle, if an immature child is of understanding age, then he should don the Ihraam and carry out the actions of Umrah like an adult. However, if he or she contravenes any of the laws of Ihraam, or commit any errors during Ihraam, then he/she will not be required to discharge the penalty. Since, your children are all under the age of puberty, they will not be required to discharge the Damm for passing the Meeqat without Ihraam. [Re:- Muallimul Hujjaj Pg.114]

However, if an adult crosses the Meeqat without Ihraam, but then returns to the Meeqat and ties the Ihraam, then the Damm falls away. If he doesn’t return to the Meeqat, then he will have to slaughter a goat or sheep within the boundaries of the Haram.
