QUESTION:
A family coming from Ta’if entered the Meeqaat without Ihraam, then left the Meeqaat and re-entered it from Masjid Sayyidah Aisha with Ihraam. What would be the ruling in this case? Would they have to give Damm?
ANSWER:
They were supposed to have donned the Ihraam before passing the Meeqaat (when coming from Ta’if). Since they crossed the Meeqaat without Ihraam, they will be required to discharge Damm. Yes, if one crosses the Meeqat without Ihraam and returns to the Meeqat, dawns the Ihraam, and re-enters, then the Damm will fall away. Since the family entered without Ihraam, they will be required to discharge the Damm. Masjid Aisha is situated at the Hil and not the Meeqat. وَلَا يَجُوزُ لِلْآفَاقِيِّ أَنْ يَدْخُلَ مَكَّةَ بِغَيْرِ إحْرَامٍ نَوَى النُّسُكَ أَوْ لَا وَلَوْ دَخَلَهَا فَعَلَيْهِ حَجَّةٌ أَوْ فِي مُحِيطِ السَّرَخْسِيِّ فِي بَابِ دُخُولِ مَكَّةَ بِغَيْرِ إحْرَامٍ (الفتاوي الهندية ج١ص٢٢١)
