Compulsion of Hajj if one is within the boundaries of the Haram in Shawwal

Question:-

If one is within the boundaries of the Haram (in Makkah Sharif and not Madina Sharif) during the months of Hajj, then will Hajj become Fardh on him?

Answer:-

Yes, Hajj will become obligatory upon him if hadn’t yet performed his Fardh Hajj. However, he must have sufficient provisions for the duration of his stay in Makkah Sharif and a valid visa to remain behind for Hajj. There shouldn’t be any restrictions (from the government) that prevent him from performing Hajj. [Re:- Kitaabun Nawaazil Pg.298 Vol.7 / Ahsanul Fataawa Pg. 529 Vol.4]

The above is applicable if one hadn’t performed his Fardh Hajj. If one had already performed his Fardh Hajj, then it will not be necessary for him to remain in Makkah Sharif until Hajj.

والفقير الاٰفاقي اذا وصل الي الميقات صار كالمكي فيجب عليه وان لم يقدر علي الراحلة (فتح ولباب) وينبغي ان يراد به الفقير المتنفل لنفسه ليخرج الفقير المامور فانه اذا وصل الي الميقات لا يصير كالمكّي , لان قدرته بقدرة غيره , وهي لا تعتبر , فلا يجب عليه الخ (غيية المناسك 18 ادارة القراٰن)  

والحاصل: أن الزاد لا بد منه ولو لمكي كما صرح به غير واحد كصاحب الينابيع والسراج،—-في اللباب: الفقير الآفاقي إذا وصل إلى ميقات فهو كالمكي قال شارحه أي حيث لا يشترط في حقه إلا الزاد والراحلة إن لم يكن عاجزا عن المشي (رد المحتار ص460 ج
