Dealing In Foreign Exchange

QUESTION:

Is it permissable to purchase Dollars in exchange for Rands on credit? If it is permitted, on what rate is the person paying in Rands liable to pay? Also, some people sell Dollars privately at a higher rate than the bank, so would this fall under Riba?

ANSWER:

1. Yes, it is permissible to trade in the buying and selling of Dollars and Rands on credit, as long as the price is fixed. There are two ways of transacting:

a) The first way is that on the day the deal is being confirmed, the rate of that day can be used and confirmed with mutual consent.

b) The second way is that the buyer and seller do not finalise the deal until the buyer is ready to buy the currency. When he is ready to buy it, then on that day the offer and acceptance should be done, and the rate of that day can be confirmed.

2. No, it does not fall under the ambit of Riba. However, buying foreign exchange on the black market is illegal according to the law of the land. Therefore, one should do it in such a way that will not bring disgrace to oneself and to the Muslim Ummah at large.

ويجوز بيع الفلس بالفلسين بأعيانهما عند أبي حنيفة وأبي يوسف – رحمهما الله -: وقال محمد – رَحِمَهُ اللَّهُ -: لا يجوز لأن الثمنية ثبت باصطلاح الكل فلا تبطل باصطلاحهما

وَإِذَا عُدِمَ الْوَصْفَانِ الْجِنْسُ وَالْمَعْنَى الْمَضْمُومُ إلَيْهِ حَلَّ التَّفَاضُلُ وَالنَّسَاءُ لِعَدَمِ الْعِلَّةِ الْمُحَرِّمَةِ وَالْأَصْلُ فِيهِ الْإِبَاحَةُ

ایک ہی ملک کی کرنسی ہونے کی صورت میں ایک روپیہ کے پچاس پیسے کے دس سکے لینا جائز نہیں ، لیکن اگر ملکی کرنسی الگ الگ ہو مثلا پاکستانی روپیہ اور ہندوستانی سکہ یا ہندوستانی روپیہ اور  پاکستانی سکہ تو اب ایسی رضامندی سے کمی بیشی کی اجازت ہے ، اس لئے کہ ہر ملک کی کرنسی الگ الگ جنس کے درجہ میں ہے ۔
