Marrying a Minor

QUESTION:

Would it be permissible to marry a girl who is not yet Baaligh?

ANSWER:

Yes, in the light of Shariah, it is permissible to get married to a minor girl with the proviso her guardian gives permission. Furthermore, if the guardian gets her married while she is not mature yet, then after she becomes mature she will have the option to continue the Nikaah or opt for an annulment.

قَالَ (وَلِلْوَلِيِّ إنْكَاحُ الصَّغِيرِ وَالصَّغِيرَةِ، وَالْوَلِيُّ الْعَصَبَةُ بِتَرْتِيبِ الْإِرْثِ).. أَيْ سَوَاءٌ كَانَتْ بِكْرًا أَوْ ثَيِّبًا اهـ… وَقَالَ: لَهَا الْخِيَارُ إذَا بَلَغَتْ (تبيين الحقائق 2/121)

أنَّ رسول الله – صلى الله عليه وسلم – تَزوج عائشة -رضي الله عنها- بِنْتُ سِتٍّ أو سَبْعِ وَبَنَى بها بِنْتُ تِسعٍ بانكَاح أبي بكر أَبيها -رضي الله عنه ..متفق عليه من حديث عائشة: “أن النبي – صلى الله عليه وسلم – تزوجها وهي بنت ست سنين وأدخلت عليه وهي بنت تسع سنين ومكثت عنده تسعًا
