Divorce due to not communicating with one’s spouse

• Question:

I wanted to know what is the ruling in regards to divorce, particularly in a situation where the husband doesn’t speak to the wife, unless absolutely necessary. He sleeps separated from her in the bed at night. This type of behaviour lasted for a period of 7 months, then everything was back to normal for a month. Again, an issue cropped up between the two, and they have reverted to their old ways of not speaking to each other and remaining separated in the bed etc. Could you kindly clarify the matter as to whether this constitutes divorce or not!

Answer:-

Although the spouses have been experiencing marital issues and occasionally separating and not talking to each other for lengthy durations, it does not constitute divorce. They will still be considered as husband and wife. May Allah Ta’ala guide them and us all towards the best!
