Falling asleep whilst seated in a car

Question:-

Does a person’s Wudhu break if he sleeps in the car whilst sitting?

Answer:-

If his back is reclining and resting against the car seat whilst his buttocks remain firm on the seat, then there are two views in this regard. According to one view, his Wudhu will be nullified. The author of Quduri, Hidaya and Imaam Tahaawi have adopted this view.

According to Dhaahir-ur-Riwaayah, his Wudhu will not be nullified. The author Al Bahrur- Raa’iq, Badaa’i-us-Sanaa’i, Allama Shaami Rahimahullah and others, have adopted this view.

It is recorded in Fataawa Hindiyyah,

ولو نام مستندا إلى ما لو أزيل عنه لسقط إن كانت مقعدته زائلة عن الأرض نقض بالإجماع وإن كانت غير زائلة فالصحيح أن لا ينقض. هكذا في التبيين   (الفتاوي الهندية ص12 ج1)

The view of Dhaahir-ur-Riwaayah seems more correct according to some scholars. In conclusion, if a person sleeps whilst reclining against some support, but he remains sitting with his buttocks on the seat or ground, then his Wudhu will remain intact, but if his buttocks don’t remain on the ground or seat, then his Wudhu will be invalidated.
