Fasting on the day of Eid-ul-Adha
Question:-
If one makes the intention of fasting on the morning of Eid until he eats from the Qurbani animal, but then eats before eating from the Qurbani animal, is it necessary to keep a Qadhaa fast?
Answer:-
In the queried scenario, there is no Qadhaa as there is no fasting on the day of Eid. The Hadith states, “Do not fast in these days for verily these are days of eating, drinking and intercourse.”
Sadaqah is given to the poor on the day of Eid-ul-Adha (from the Qurbani animal) after slaughtering, hence we too refrain from eating until the animal is slaughtered and given to the poor. In conclusion, our refraining from eating until the Qurbani is completed, is not considered as a Shari’ee fast.
اخرجه الدارقطني بلفظ لا تصوموا في هذه الأيام فإنها أيام أكل وشرب وبعال يعني أيام منى – وفي إسناده الواقدي (وأنس) أخرجه الدارقطني بلفظ أن النبي صلى الله عليه وسلم نهى عن خمسة أيام في السنة يوم الفطر ويوم النحر وثلاثة أيام التشريق وفي إسناده محمد بن خالد الطحان وهو ضعيف (تحفة الاحوذي)
وأخرج أيضا عمر بن خلدة الزرقي عن أمه قالت: (بعث رسول الله صلى الله عليه وسلم علي بن أبي طالب في أوسط أيام التشريق، فنادى في الناس: لا تصوموا في هذه الأيام فإنها أيام أكل وشرب وبعال) . وأخرجه ابن أبي شيبة في (مسنده) – (عمدة القاري ص115 ج11)
وإنما فرّق بينهما لأن السُّنّة أن يتصدّق في عيد الفطر قبل الصلاة، فاستحب له الأكل ليشارك المساكين في ذلك، والصدقة في يوم النحر إنما هي بعد الصلاة من الأضحية، فاستحب موافقتهم (ارشاد الساري ص207 ج2)
