Hajj-e-Badl
QUESTION:-
Can a person intending to perform Hajj-e-Badl make Hajj-e-Tamattu?
ANSWER:-
It is not permissible for a person who is performing Hajj-e-Badl to perform Hajj-e-Tamattu. This is the view of Hadrat Mufti Mahmood Hassan Saheb Gangohi Rahimahullah, which is the view of our Darul Ifta as well. This is the view recorded in other Kitaabs as well such as, Ghunyatun Naasik.

عدم المخالفة : فلو امره بالحج فتمتع ولو عن الآمر فهو مخالف ضامن.. (غنية الناسك ص179)
واما في التمتع فلو امره بالتمتع فتمتع عنه فالحج يقع عن المامور لا عن الامر علي ما مر من المشائخ (غنية الناسك ص186)
Furthermore, if the person performing Hajj-e-Badl wishes to go to Madinah Munawwarah, then he should proceed directly to Madinah Munawwarah from Jeddah. Thereafter, he should tie his Ihraam for Hajj from Madinah Munawwarah (or from the Meeqat known as, Dhul Hulaifah) a few days before Hajj, and then proceed to Makkah Sharif. This is the safest method.

Yes, if some person appoints another to perform Hajj-e-Badl on behalf of the Marhoom (and he will be bearing the total cost of performing Hajj), then Hajj-e-Tamattu may be performed with his explicit consent, but the Damm-e-Shukr will be on the one performing the Hajj, unless the sender is prepared to cover the cost of Damm-e-Shukr.
