QUESTION:
A few students from school get together on a Friday at 4.00pm to perform Jumuah in the Masjid (making it a second Jumuah in the Masjid). If the first Asr time (Shafi’ee) is before 4.00pm, is it still fine for us to read the Jumuah after that time, before the coming in of the second Asr time (Hanafi)?
ANSWER:
The time for Jumuah Salaah is the same as the time of Zuhr Salaah. Hence, the time of Jumuah starts immediately after Zawaal, and ends when the shadow of an object reaches twice its length, according to the Hanafi school of thought. However, if a few individuals missed the Jumuah Salaah, then Zuhr Salaah should be performed individually without Adhaan and Iqaamah. [Re:- Fataawa Uthmaaniyyah Pg.442 Vol.2] It is not correct for the students to have a second Jamaat in the Masjid without a valid reason. The students should request the school to permit them to perform Jumuah with Jamaat in the Masjid at its appointed time. Alternately, the school students should perform Jumuah Salaah at a venue where the Jumuah Salaah is delayed for the convenience of school and campus students. Missing the Jumuah Salaah with Jamaat due to school is not a valid excuse in terms of Shariah, hence the matter should be taken up with the principal or school governing body. We really don’t see an issue with the authorities allowing students to attend the congregational Salaah, as Jumuah Salaah is held generally during the school lunch time. Also, majority of the schools in the country permit their learners to attend the Jumuah Salaah as they are all aware of the sanctity of Jumuah.
Yes, if there is a school hall on the school premises, then the hall may be used by the learners to perform their Jumuah Salaah. The Muslim teachers or learners may request the Ulama of the town to fill in a roster to lead the Salaah. By doing so, the Jumuah Salaah can be performed on time without any delay or inconvenience, with the proviso that the school is in a town where Jumuah takes place.
قَوْلُهُ وَوَقْتُ الظُّهْرِ) أَيْ شَرْطُ صِحَّتِهَا أَنْ تُؤَدَّى فِي وَقْتِ الظُّهْرِ فَلَا تَصِحُّ قَبْلَهُ، وَلَا بَعْدَهُ؛ لِأَنَّ شَرْعِيَّةَ الْجُمُعَةِ مَقَامَ الظُّهْرِ عَلَى خِلَافِ الْقِيَاسِ؛ لِأَنَّهُ سُقُوطُ أَرْبَعٍ بِرَكْعَتَيْنِ فَتُرَاعَى الْخُصُوصِيَّاتُ الَّتِي وَرَدَ الشَّرْعُ بِهَا مِمَّا لَمْ يَثْبُتْ دَلِيلٌ عَلَى نَفْيِ اشْتِرَاطِهَا، وَلَمْ يُصَلِّهَا – عَلَيْهِ السَّلَامُ – خَارِجَ الْوَقْتِ فِي عُمُرِهِ وَلَا بِدُونِ الْخُطْبَةِ فِيهِ فَيَثْبُتُ اشْتِرَاطُهُمَا(البحر الرائق ج2ص157
ويكره تكرار الجماعة بأذان وإقامة في مسجد محلة لا في مسجد طريق أو مسجد لا إمام له ولا مؤذن…..و في الشامية: (قوله ويكره) أي تحريما لقول الكافي لا يجوز والمجمع لا يباح وشرح الجامع الصغير إنه بدعة كما في رسالة السندي(شامي ج1ص552)
