Imaam reciting against the sequence in Salaah

Question:-

If an Imaam recites a Surah in the first Rakaat of the Esha Salaah, and then recites a Surah that is before it in the second Rakaat, what is the condition of the Salaah? For example, the Imaam recited Surah Mutaffifeen in the first Rakaat and then Surah Infitaar in the second Rakaat. Is the Salaah valid?

Answer:-

If an Imaam forgetfully recites the Surahs in Salaah against the sequence (as recorded in the Mushaf), then the Salaah will be valid and Sajdah-e-Sahw will not be obligatory, as the sequence (of recitation) is from the Waajibat of Qiraat and not from the Waajibaat of Salaah.

وفي التجنيس لو قرأ سورة ثم قرأ في الثانية سورة قبلها ساهيا لا يجب عليه السجود لأن مراعاة ترتيب السور من واجبات نظم القرآن لا من واجبات الصلاة فتركها لا يوجب سجود السهو ) البحر الرائق ص94 ج2)
