Issuing Three Talaaqs Unknowingly

QUESTION:

If a person uttered three Talaaqs to his wife unknowingly, will the Talaaq be valid?

ANSWER:

If a person utters three Talaaqs, irrespective of knowing the circumstances surrounding it or not, three Talaaqs will take effect. The husband should immediately separate from his wife as the Nikaah has terminated.

وقوله عليه الصلاة والسلام: “ثلاث جدهن جد وهزلهن جد”: يدل على ذلك أيضًا؛ لأنه عليه الصلاة والسلام سوى بين الجاد والهازل، مع وجود الإرادة من أحدهما في إيقاع حكم اللفظ وعدمها من الآخر، مع كونهما من أهل التكليف،(شرح مختصر للطحطاوي 5/15)
