Passing The Miqaat in the State of Haidh

Q1. What is the ruling regarding Ihraam if I pass the Miqaat in a state of Haidh?

A1. You are required to pass the Miqaat in a state of Ihraam if you intend proceeding to Makkah Mukarramah. Since you are in Haidh, you are only required to make Niyyah of Ihraam and will not have to perform the Sunnah Salaah. Passing the Miqaat without being in the state of Ihraam is a sin.

لا يجاوز أحد الميقات إلا محرما ، وكذلك لو أراد بمجاوزة هذه المواقيت دخول مكة لا يجوز له أ يجاوزها إلا محرما، سواء أراد بدخول مكة النسك من الحج أو العمرة أو التجارة أو حاجة أخرى عندنا (بدائع الصنائع 2 /164)

Q2. If I go back to the Miqaat, does the Damm fall away?

A2. If you passed the Miqaat without Ihraam, then a Damm will be applicable, even though you may be in Haidh. However, if you return to the Miqaat and re-enter in a state of Ihraam, then the Damm will fall away.

من جاوز وقته غير محرم ثم احرم او لا فعليه العود الي وقت وان لم يعد فعليه دم (غنية الناسك ص30)

Q3. Do I have to go back to the same Miqaat which I passed by, or can I go to the closest Miqaat e.g. Masjid Aisha?

A3. It is not necessary to go back to the same Miqaat that you had passed. You may go back to the closest Miqaat i.e. Masjid Aisha.

(وحرم تأخير الإحرام عنها) كلها (لمن) أي لآفاقي (قصد دخول مكة) يعني الحرم (ولو لحاجة) غير الحج(قوله وحرم إلخ) فعليه العود إلى ميقات منها وإن لم يكن ميقاته ليحرم منه، وإلا فعليه دم كما سيأتي بيانه في الجنايات (الدر المختار و حاشية ابن عابدين 2/476)
