Laughing Loudly In Salaah

Q1. If a person laughs aloud in Salaah, such that he can be heard by others, is he allowed to touch the Quraan Sharif thereafter? Is this considered a state of Hadath?

A1. The opinion of the Hanafi Madhab is that laughing aloud in Salaah breaks both Wudhu and Salaah. Laughing aloud in itself is not considered as Hadath, but based upon the Hadith of the Prophet Sallallahu Alaihi Wasallam, Wudhu is broken. Therefore, one is not allowed to touch the Quraan Sharif in such a state.

Q2. For those who say it is for reprimanding the person and not Hadath, then according to that ruling, can a person make Tawaaf with that Wudhu, or not?

A2. Allamah Shami mentions that it does not mean that Wudhu remains valid and one is just reprimanded to repeat it. Rather, Wudhu in itself is broken. Therefore, one is not allowed to perform Tawaaf in such a state.

قَوْلُهُ: وَقَهْقَهَةٌ) قِيلَ: إنَّهَا مِنْ الْأَحْدَاثِ, وَقِيلَ: لَا وَإِنَّمَا وَجَبَ الْوُضُوءُ بِهَا عُقُوبَةً وَزَجْرًا. وَفَائِدَةُ الْخِلَافِ فِي مَسِّ الْمُصْحَفِ يَجُوزُ عَلَى الثَّانِي لَا الْأَوَّلِ كَمَا فِي الْمِعْرَاجِ. قَالَ فِي النَّهْرِ: وَيَنْبَغِي أَنْ يَظْهَرَ أَيْضًا فِي كِتَابَةِ الْقُرْآنِ. وَأَمَّا حِلُّ الطَّوَافِ بِهَذَا الْوُضُوءِ فَفِيهِ تَرَدُّدٌ, وَإِلْحَاقُ الطَّوَافِ بِالصَّلَاةِ يُؤْذِنُ بِأَنَّهُ لَا يَجُوزُ فَتَدَبَّرْهُ. وَرَجَّحَ فِي الْبَحْرِ الْقَوْلَ الثَّانِيَ بِمُوَافَقَتِهِ لِلْقِيَاسِ لِأَنَّهَا لَيْسَتْ خَارِجًا نَجَسًا بَلْ هِيَ صَوْتٌ كَالْكَلَامِ وَالْبُكَاءِ وَبِمُوَافَقَتِهِ لِلْأَحَادِيثِ الْمَرْوِيَّةِ فِيهَا, إذْ لَيْسَ فِيهَا إلَّا الْأَمْرُ بِإِعَادَةِ الْوُضُوءِ وَالصَّلَاةِ, وَلَا يَلْزَمُ مِنْهُ كَوْنُهَا حَدَثًا اهـ. وَأَيَّدَهُ فِي النَّهْرِ بِقَوْلِ الْمُصَنِّفِ وَغَيْرِهِ بَالِغٌ وَلَوْ كَانَتْ حَدَثًا لَاسْتَوَى فِيهَا الْبَالِغُ وَغَيْرُهُ وَبِتَرْجِيحِهِمْ عَدَمَ النَّقْضِ بِقَهْقَهَةِ النَّائِمِ أَيْ لِعَدَمِ الْجِنَايَةِ مِنْهُ كَالصَّبِيِّ.

أَقُولُ: ثُمَّ لَا يَخْفَى أَنَّ مَعْنَى الْقَوْلِ الثَّانِي بُطْلَانُ الْوُضُوءِ بِالْقَهْقَهَةِ فِي حَقِّ الصَّلَاةِ زَجْرًا كَبُطْلَانِ الْإِرْثِ بِالْقَتْلِ وَإِنْ لَمْ يَبْطُلْ فِي حَقِّ غَيْرِهَا لِعَدَمِ الْحَدَثِ, وَلَيْسَ مَعْنَاهُ أَنَّ الْوُضُوءَ لَمْ يَبْطُلْ وَإِنَّمَا أُمِرَ بِإِعَادَتِهِ زَجْرًا, حَتَّى يَرِدَ أَنَّهُ يَلْزَمُهُ أَنَّهُ لَوْ صَلَّى بِهِ صَحَّتْ الصَّلَاةُ مَعَ الْحُرْمَةِ وَوُجُوبِ الْإِعَادَةِ فَيَكُونُ مُخَالِفًا لِأَصْلِ الْمَذْهَبِ, فَافْهَمْ
