Making patties with Qurbani meat and selling it

Question:-

My mother made Qurbani and gifted the meat to her sister. Is it allowed for her sister to make patties from that meat, and sell burgers?

Answer:-

In principle, when a person is gifted an item, then he or she becomes the owner of it by accepting the gift and taking possession of it. It is then the donee’s prerogative to use the gift according to his or her discretion. Hence, if the donee produces meat products (such as patties) using the Qurbani meat and then sells it, the income derived therefrom will be in order. This ruling is only applicable when the owner gifts the meat to another person.

However, one should keep in mind that Qurbani meat is a gift to us from Allah Ta’ala, thus the blessed meat is to be eaten and is not for deriving an income. It is the favour of Allah Ta’ala upon this Ummah that we are permitted to consume Qurbani meat, unlike the previous Ummats who were not permitted to consume the meat of the Qurbani animal. We should therefore consume the meat considering it to be a favour of Allah Ta’ala upon us, instead of selling the meat or meat products manufactured from the Qurbani meat.

لیکن اگر مالک نے تحفہ میں یا ہبہ میں دیدیا تو اس دوسرے کے لئے فروخت کرکے پیسوں کو اپنے تصرف میں لانا بھی جائز  ہے (فتاوی قاسمیہ ص۴۶۶ ج۲۲)
