Touching The Ka’bah Sharif Whilst in Ihraam
QUESTION:
If one touches the Ka’bah Sharif whilst in the state of Ihraam, is a penalty required to be paid? If so how much?
ANSWER:
A person in the state of Ihraam should not touch the Ka’bah Sharif due to the excessive amount of ‘Itr (perfume) that is applied to it. It is possible that the ‘Itr (perfume) can come onto one’s body by touching the Ka’bah Sharif which will result in a person having to sacrifice a goat or sheep (Damm), or having to pay the value of Sadaqatul Fitr.
If a small amount of ‘Itr (perfume) was applied to a complete limb (such as the hand), then such a person would have to sacrifice a goat or sheep (Damm).
If a small amount of ‘Itr was applied to a portion of a limb, then such a person would have to pay the value of Sadaqatul Fitr.
If a large amount of ‘Itr was applied to one quarter of a limb or more, then such a person would have to sacrifice a goat or sheep (Damm).
If a large amount of ‘Itr was applied to less than one quarter of a limb, then such a person would have to pay the value of Sadaqatul Fitr.
وَالصَّحِيحُ أَنْ يُوَفَّقَ وَيُقَالُ إنْ كَانَ الطِّيبُ قَلِيلًا فَالْعِبْرَةُ لِلْعُضْوِ لَا لِلطِّيبِ حَتَّى لَوْ طَيَّبَ بِهِ عُضْوًا كَامِلًا يَكُونُ كَثِيرًا يَلْزَمُهُ دَمٌ وَفِيمَا دُونَهُ صَدَقَةٌ، وَإِنْ كَانَ الطِّيبُ كَثِيرًا فَالْعِبْرَةُ لِلطِّيبِ لَا لِلْعُضْوِ حَتَّى لَوْ طَيَّبَ بِهِ رُبْعَ عُضْوٍ يَلْزَمُهُ دَمٌ هَكَذَا فِي مُحِيطِ السَّرَخْسِيِّ وَالتَّبْيِينِ هَذَا فِي الْبَدَنِ
