Non-Muslim father representing his daughter at the time of Nikah

Question:-

Can a non-Muslim father represent his daughter at the time of Nikah?

Answer:-

A non-Muslim father cannot be a Wali for his Muslim daughter, but he may be a Wakeel (one who represents her at the time of Nikah and hands her over in marriage). Hence, if the Muslim daughter makes the non-Muslim father her Wakeel and he gets her married in front of two Muslim witnesses, then the Nikah will take place.

نومسلمہ کے نکاح میں غیر مسلم کی ولایت کا حکم :

سوال: ایک عورت ابھی مسلمان ہوئی اور مسلمان کے ساتھ نکاح کا ارادہ ہے اور اس کے والد اور بھائی غیر مسلم ہیں، کیا اس کے نکاح میں باپ یا بھائی ولی بن سکتا ہے؟

الجواب : صورتِ مسئولہ میں مسلمان کے نکاح میں کا فرولی نہیں بن سکتا لیکن کافر کی وکالت صحیح ہے

پس اگر نومسلمہ نے کا فر باپ یا بھائی کو اپنے نکاح کا وکیل بنایا اور اس نے دو مسلمان گواہوں کے رو برونکاح

کی تو صیح ہے، اگر چہ عاقلہ بالغہ عورت بغیر ولی کے بھی اپنا نکاح کرسکتی ہے۔
