Question:-
According to the Shariah, are Non-Muslims not allowed to enter only Makkah and Madinah, or are they not allowed to enter the entire Hijaaz. Can Muftisahib please give details regarding when this was ordained in Islam, and also the status of it ( is it compulsory to implement at all times)?
Answer:-
One of the commands of Rasulullah Salallahu Alaihi Wasallam (before leaving the temporary world) was to remove the Jews and the Christians from the Arabian Peninsula. The command of Rasulullah Salallahu Alaihi Wasallam was general and cannot be confined only to his time but rather, the command will be applicable to all times. Such importance was attached to removing the Jews and Christians from the Arabian Peninsula, that Rasulullah Salallahu Alaihi Wasallam stated, “If I live, if Allah Ta’ala wills, then I will remove the Jews and the Christians from the Arabian Peninsula to the extent that I will not leave in it except a Muslim.” The Sahaaba executed this command of Rasulullah Salallahu Alaihi Wasallam and cleansed the Arabian Peninsula of the Kuffar.The command of Rasulullah Salallahu Alaihai Wasallam to remove the Jews and Christians refers to the entire Arabian Peninsula as stated in the Hadith and not only Hijaaz-e-Muqaddas. Hijaaz refers to Makkah Mukarramah, Madinah Munawwarah and Ta’if, according to the books of Taareekh.
وَعَنْ أَبِي عُبَيْدَةَ بْنِ الْجَرَّاحِ – رضي الله عنه – قَالَ: ” كَانَ آخِرُ مَا تَكَلَّمَ بِهِ رَسُولُ اللهِ – صلى الله عليه وسلم – أَنْ قَالَ: أَخْرِجُوا يَهُودَ أَهْلِ الْحِجَازِ وَأَهْلِ نَجْرَانَ مِنْ جَزِيرَةِ الْعَرَبِ , وَاعْلَمُوا أَنَّ شِرَارَ النَّاسِ الَّذِينَ اتَّخَذُوا قُبُورَ أَنْبِيَائِهِمْ مَسَاجِدَ “(الجامع الصحيح للسنن والمسانيد)
وَعَنْ عُمَرَ بْنَ الْخَطَّابِ – رضي الله عنه – أَنَّ رَسُولَ اللهِ – صلى الله عليه وسلم – قَالَ: (” لَئِنْ عِشْتُ إِنْ شَاءَ اللهُ لَأُخْرِجَنَّ الْيَهُودَ وَالنَّصَارَى مِنْ جَزِيرَةِ الْعَرَبِ حَتَّى لَا أَتْرُكَ فِيهَا إِلَّا مُسْلِمًا ” (الجامع الصحيح للسنن والمسانيد)
وأوصى -صلى اللَّه عليه وسلم- عند موته: أخرجوا اليهود من جزيرة العرب، وأجيزوا الوفد بنحو ما كنت أجيزهم وأوصى بعترته وصدقة أرضه.(ابو داود)
