Paying Zakaah From Personal Funds

QUESTION:

A Wakeel for a Zakaah organization tells one of the Aalimleen (person A) to take R4 000.00 and give it to a specific individual who is eligible to receive Zakaah. Person A does not have access to the Zakaah money in the account, so he takes R3 000.00 from his personal account and gives it to the person who is eligible for Zakaah.

When the Wakeel returns, can he return the R3 000.00 to person A, as he used his own money? In future, what would be the preferred procedure in a case like this?

 

ANSWER:

The Zakaah will be discharged and person A may claim the money back. It is permissible to dispense the Zakaah in this manner in future, but it would be preferable to pay it directly from the Zakaah money.

قال في البحر : ولو تصدق عنه بأمره جاز ويرجع بما دفع عند أبي يوسف (رد المحتار ٢/٢٦٩)

( قوله ولو تصدق إلخ ) أي الوكيل بدفع الزكاة إذا أمسك دراهم الموكل (رد المحتار ٢٧٠/٢)
