Performing Salaah without Wudhu

Question:-

A person feels the sensation of a drop involuntary discharging out of his front private-part whilst in Salaah.

There are two scenarios:

1. He is uncertain as to whether a drop emerged or not, or whether his trousers came into contact with the private-part exit point creating the sensation, and he, therefore, continues with Salaah.

2. He is certain that something has emerged and his Wudhu is broken, but due to embarrassment, he does not break his Salaah and continues reading but with guilt in his heart.

Has the person lost his Imaan in any of the above scenarios? I read somewhere that reading Salaah without Wudhu is Kufr – should the person repeat his Kalimah & Nikah?

Answer:-

1. If there was no certainty in his Wudhu being nullified, but he experienced some sort of sensation or doubt, then Salaah will not be invalid on the basis of such a doubt. The principle of the jurists is that certainty is not removed due to doubt.

2. If his Wudhu broke with certainty, but he continued with his Salaah due to the embarrassment of leaving the congregation, then he should sincerely repent and repeat the Salaah. In this case, his Imaan will remain intact Insha’Allah and there is no need to renew his Imaan and Nikah. However, he should refrain from doing so in the future.

Fataawa Hindiyyah states that, if one intentionally performs Salaah without Wudhu, then he will lose his Imaan. However, in the above instance, he continued with his Salaah due to embarrassment, hence, he should sincerely repent for his actions as explained above.

ولَوْ صَلَّى بِغَيْرِ وُضُوءٍ مُتَعَمِّدًا يَكْفُرُ قَالَ الصَّدْرُ الشَّهِيدُ – رَحِمَهُ اللَّهُ تَعَالَى – وَبِهِ نَأْخُذُ (الفتاوي الهندية ص268 ج2)
