Referring to one’s wife as one’s mother

QUESTION:

If I jokingly tell my wife, “You are just like my mother,” referring to an action they both have in common, will this fall under Zihaar?

ANSWER:

Fundamentally, uttering the words ‘you are like my mother’ falls in the category of ambiguous or unclear words. Therefore, the intention of the speaker will be taken into consideration when uttering them. If the speaker intends Talaaq or Zihaar when uttering these words, then it will be regarded as Talaaq or Zihaar, otherwise not.

In the queried scenario, the words mentioned would not be regarded as Zihaar, due to the speaker not having the intention of Zihaar or Talaaq [[i]].

Keeping the above in mind, the Fuqahaa have mentioned that it will still be Makrooh to utter such words despite one not having the intention of Talaaq or Zihaar. Hence, one should endeavour to the best of his ability not to utter such words.

(وإن قال أنت علي مثل أمي) أو كأمي، وكذا لو حذف (على) خانية (رجع إلى نيته) لينكشف حكمه (فإن قال أردت الكرامة فهو كما قال) ، لأن التكريم في التشبيه فاشٍ في الكلام (وإن قال أردت الظهار فهو ظهار) ، لأنه تشبيه بجميعها، وفيه تشبيه بالعضو، لكنه ليس بصريح فيفتقر إلى النية (وإن قال أردت الطلاق فهو طلاق بائن) لأنه تشبيه بالأم في الحرمة؛ فكأنه قال (أنت علي حرام) ونوى الطلاق (وإن لم تكن له فيه نية) أو حذف الكاف كما في الدار (فليس بشيء) لاحتمال الحمل على الكرامة، وهذا عند أبي حنيفة وأبي يوسف وقال محمد: يكون ظهاراً، قال جمال الإسلام في شرحه: الصحيح قول أبي حنيفة وأبي يوسف، واعتمده البرهان والنسفي وغيرهما. تصحيح.
