QUESTION:
I’ve heard that if a husband looks at the inner part of his wife’s front private part, their Nikaah will break?
1. Is this true?
2. Does it have to be done with lust?
3. If the Nikaah is broken, will it have to be renewed?
ANSWER:
By looking at the wife’s vagina, the Nikah does not break. Perhaps you are referring to the Mas’ala of Hurmat-e-Musaaharat, where if a person looks into the vagina of his daughter, or mother-in-law for example with lust, then his wife will become Haraam upon him. Although it is fundamentally permissible to look at the wife’s entire body including her private part, it is appropriate to consider the Hadith of Aisha Radiallahu Anha recorded in Mirqaat; “Rasulullah Sallallahu Alaihi Wasallam did not see me and I did not see him.”
ما راي مني وما رايت منه (مرقاة ص414 ج3)
ثُمَّ مَعْنَى الشَّهْوَةِ الْمُعْتَبَرَةِ فِي الْمَسِّ وَالنَّظَرِ أَنْ تَنْتَشِرَ بِهِ الْآلَةُ أَوْ يَزْدَادَ انْتِشَارُهَا، فَأَمَّا مُجَرَّدُ الِاشْتِهَاءِ بِالْقَلْبِ غَيْرُ مُعْتَبَرٍ.
أَلَا تَرَى أَنَّ هَذَا الْقَدْرَ يَكُونَ مِنْ الشَّيْخِ الْكَبِيرِ الَّذِي لَا شَهْوَةَ لَهُ، وَالنَّظَرُ إلَى الْفَرْجِ الَّذِي تَتَعَلَّقُ بِهِ الْحُرْمَةُ هُوَ النَّظَرُ إلَى الْفَرْجِ الدَّاخِلِ دُونَ الْخَارِجِ، وَإِنَّمَا يَكُونُ ذَلِكَ إذَا كَانَتْ مُتَّكِئَةً أَمَّا إذَا كَانَتْ قَاعِدَةً مُسْتَوِيَةً أَوْ قَائِمَةً لَا تَثْبُتُ الْحُرْمَةُ بِالنَّظَرِ، ثُمَّ حُرْمَةُ الْمُصَاهَرَةِ بِهَذِهِ الْأَسْبَابِ تَتَعَدَّى إلَى آبَائِهِ، وَإِنْ عَلَوْا وَأَبْنَائِهِ، وَإِنْ سَفُلُوا مِنْ قِبَلِ الرِّجَالِ وَالنِّسَاءِ جَمِيعًا، وَكَذَلِكَ تَتَعَدَّى إلَى جَدَّاتِهَا وَإِلَى نَوَافِلِهَا لِمَا بَيَّنَّا أَنَّ الْأَجْدَادَ وَالْجَدَّاتِ بِمَنْزِلَةِ الْآبَاءِ وَالْأُمَّهَاتِ، وَالنَّوَافِلُ بِمَنْزِلَةِ الْأَوْلَادِ فِيمَا تَنْبَنِي عَلَيْهِ الْحُرْمَةُ، وَذَلِكَ كُلُّهُ مَرْوِيٌّ عَنْ إبْرَاهِيمَ النَّخَعِيِّ – رَحِمَهُ اللَّهُ تَعَالَى (المبسوط للسرخسي ص208 ج4)
