QUESTION:
When filling in the marriage certificate form, do the witnesses to the bride’s Nikaah have to be her Mahram, or can it be any male figure that she is close to, for example, her Khala’s husband?
ANSWER:
It is best that the father is appointed as the representative when getting his daughter married. Yes, in the absence of the father, any of her Mahrams may be appointed as her representative or, in their absence, any other Muslim person. Any two mature Muslim males can be witness to the consent granted to the representative by the bride irrespective of whether they are Mahaarim to the bride or not, although it will be better to have Mahaarim as witnesses.
