Using The Word “Qasam”
QUESTION:
Regarding the use of the word Qasam, is it true that it does not trigger Kaffaarah if only the word Qasam is said without attaching “Wallahi” to it?
ANSWER:
If the term “Qasam” (قسم) is used with the intention of an oath, it constitutes a Yameen (oath) and its rulings apply. For example, saying “Qasam, I will do such-and-such” with that intention is a valid oath, and breaking it requires Kaffaarah (expiation).
An oath is not limited to expressions like “Wallahi“; rather, “Qasam” with the intention of swearing is sufficient.
“ولو قال اقسم أو أقسم بالله أو أحلف أو أحلف بالله أو أشهد أو أشهد بالله فهو حالف” لأن هذه الألفاظ مستعملة في الحلف وهذه الصيغة للحال حقيقة وتستعمل
