Requesting debtor to gift funds

Oct 24, 2022 | Gifts

Question:-

Someone owed me money but I already made the intention of forgiving his debt and hadn’t told him as yet. After a few months, he comes to me with the money and I now feel like taking the money, so I tell him “I already forgave your debt, but if you want to give me the money with the intention of a gift, you can give it to me.” Would that money be Halaal for me to use?

Answer:-

When the debtor came to repay the debt you told him that the debt has been forgiven, hence there was no need for him to pay the debt any longer. Now, if you request him to willingly gift the money to you, and he voluntarily gifts it to you, then there is no harm in accepting the funds and utilizing it. However, if he is not willing to gift the money on your request, then it cannot be held against him, as the debt was previously forgiven and your reward is with Allah Ta’ala Insha’Allah.
