Question:-
We don’t have Jumuah Salaah in our area. What are the requisites for Jumuah Salaah? We have shops, a petrol station, a post office, proper streets and homes, doctors etc. Are we permitted to start with Jumuah Salaah? Can we have Eid Salaah as well? Please advise!
Answer:-
The Kitaabs of Fataawa state that if there are 3000 people or more in a locality (wherein the daily basic needs of the community are found), then Jumu’ah in such a locality is permitted [Re:- Kitaabun Nawaazil Pg. 181 Vol.5 – Fataawa Mahmoodiyya Dhabel Pg. 137 Vol.8 ].
According to Imaam Abu Hanifa Rahmatullahi Alaih, Jumu’ah is valid in a large town which comprises of streets, markets/shops, and wherein there is a ruler or authority that is able to afford justice to the oppressed (from the oppressor) through his knowledge or the knowledge of another person, and people will refer to him at the time of tragedy. This is the most correct view [Re:- Shaami].
Fataawa Bismillah states that a village that takes the same ruling as a small town, meaning that, the needs of the people are fulfilled in it and comprises of little streets, then Jumu’ah and Eid Salaah is necessary upon the people of such a town.

The indications of a place wherein Jumu’ah is permitted is as follows: the place should comprise of streets, homes, tradesmen that are generally required, post office, hospital or doctors, a judge or an arbitration committee, and shops where one’s daily needs can be fulfilled (which are functional on a daily basis).

From the description provided by you, it seems that the necessary requirements for the validity of Jumu’ah are found, hence, Jumu’ah may be performed in such an area. There should be at least three Baaligh males and the Imaam present for the Jumu’ah Salaah. An effort should be made to establish the 5 daily Salaah at the Musallah, particularly by those brothers that are living in close vicinity to the Musallah.
The requirements for the Eid Salaah are the same as Jumu’ah, hence, Eid Salaah will also be permitted in the area.
(Our advice to you is that you also consult some other Darul Ifta/Mufti, in order to further verify and confirm that the requirements of Jumu’ah and Eid are found in the queried locality).
