Slaughtering carried out by an alcoholic

QUESTION:

1. I would like to know, in that moment of being intoxicated, will the Tasmiya be counted if he cut the animal the next day and he had drank alcohol the night before?

2. I would also like to know what about eating from Muslim familes who support this person? Do we eat if we are offered or would it be better to refrain?

ANSWER:

1. The slaughterer is required to be a Muslim and a person of understanding, meaning that he should not be an insane person. [Re:- Fataawa Uthmaaniyyah Vol:8 Pg:294] Now, if the person consumed alcohol the night before and was therefore intoxicated when slaughtering, but he recited the Tasmiyah, then his slaughtering will be acceptable. [Re:- Fataawa Darul Uloom Deoband Pg.422 Vol.15/ Fataawa Mahmoodiyyah Pg.115 Vol.26] However, as stated previously, we should purchase our meat from reliable and pious people if we aren’t able to personally slaughter our own animals, as the transgressor could omit the Tasmiyah intentionally without us knowing, in which case the meat will be Haraam.

2. Since, the slaughterer is a Faasiq and cannot be trusted, it will be best not to attend Dawats where his meat will be served. This is as a precautionary measure. Matters pertaining to Halaal and Haraam are extremely sensitive in Shariah, as a single morsel of Haraam could cause devastating effects to ones Imaan and spiritual health. It is mentioned in a Hadith:

عن أبي هريرة، قال: قال رسول الله صلى الله عليه وسلم: ” أيها الناس، إن الله طيب لا يقبل إلا طيبا، وإن الله أمر المؤمنين بما أمر به المرسلين، فقال: {يا أيها الرسل كلوا من الطيبات واعملوا صالحا، إني بما تعملون عليم} [المؤمنون: 51] وقال: {يا أيها الذين آمنوا كلوا من طيبات ما رزقناكم} [البقرة: 172] ثم ذكر الرجل يطيل السفر أشعث أغبر، يمد يديه إلى السماء، يا رب، يا رب، ومطعمه حرام، ومشربه حرام، وملبسه حرام، وغذي بالحرام، فأنى يستجاب لذلك؟ “

Hadrat Abu Hurairah Radiallahu Anhu narrates that Rasulullah Salallahu Alaihi Wasallam is reported to have said, “O people! Verily Allah Ta’ala is pure and does not accept except that which is pure. Verily Allah Ta’ala has ordered the Muslims as he has ordered the messengers Alaihim-us-Salaam.” Allah Ta’ala said “O messengers, Eat from that which is pure and do good deeds, for verily I am aware of what you do.” And He said “O you who believe! Eat from the pure things that we have provided you.” Then he mentioned a person that undertakes a lengthy journey and is therefore in a dishevelled and dusty state. He spreads his hands towards the skies and says, O my Rabb! O my Rabb! whereas his food is Haraam, his drink is Haraam, his clothing is Haraam and he has been nourished by Haraam. How will his supplication be accepted? [Muslim Shareef:1015]

It is recorded in another Hadith:

عن النعمان بن بشير، قال: سمعته يقول: سمعت رسول الله صلى الله عليه وسلم، يقول: – وأهوى النعمان بإصبعيه إلى أذنيه – «إن الحلال بين، وإن الحرام بين، وبينهما مشتبهات لا يعلمهن كثير من الناس، فمن اتقى الشبهات استبرأ لدينه، وعرضه، ومن وقع في الشبهات وقع في الحرام……الخ.

Hadrat Naumaan Bin Basheer Radiallahu Anhu says that I heard Rasulullah Salallahu Alaihi Wasallam saying – Naumaan indicated towards his ears-,“Verily Halaal is clear and Haraam is clear and in between them are doubtful things which most of the people are unaware of. The one who refrains from doubtful things will protect his Deen, whilst the one who falls into doubtful things will fall into Haraam. [Muslim Sharif:1599]

From the above Hadith, we understand the importance of consuming Halaal and refraining from Haram and doubtful things.
