Surrogacy

Question:-

If a couple goes through a process of surrogacy, in shariah, who will the child be attributed to?

Also, who will be the father if the surrogate mother is a married women? To the sperm Donner or the surrogates husband?
Will الولد للفراش apply anywhere here?

Answer:-

Surrogacy refers to a pregnancy in which a woman carries and gives birth to a baby for a person is who not able to have children. In a surrogate pregnancy, eggs from the women who will carry the baby are fertilized with sperm from a sperm donor.

If the surrogate mother is married, then the lineage of the child will be attributed to her husband and she will be the mother as the Hadith states, “Al-Waladu Lil Firaash,”. Since the lineage of the child will be attributed to the husband, the husband will be responsible to maintain the child, the laws of inheritance will be applicable, there is no Purdah between the female offspring and the surrogacy’s husband, etc.

In conclusion, the woman who gave birth to the child will be considered as the mother and her husband will be the father, as explained above.

أما الأول فنسب الولد من الرجل لا يثبت إلا بالفراش وهو أن تصير المرأة فراشا له لقوله – عليه الصلاة والسلام – «الولد للفراش وللعاهر الحجر» .

ودلالة الحديث من وجوه ثلاثة: أحدها: أن النبي – عليه الصلاة والسلام – أخرج الكلام مخرج القسمة فجعل الولد لصاحب الفراش والحجر للزاني فاقتضى أن لا يكون الولد لمن لا فراش له كما لا يكون الحجر لمن لا زنا منه إذ القسمة تنفي الشركة والثاني أنه – عليه الصلاة والسلام – جعل الولد لصاحب الفراش ونفاه عن الزاني بقوله – عليه الصلاة والسلام – وللعاهر الحجر لأن مثل هذا الكلام يستعمل في النفي والثالث أنه جعل كل جنس الولد لصاحب الفراش فلو ثبت نسب ولد لمن ليس بصاحب الفراش لم يكن كل جنس الولد لصاحب الفراش وهذا خلاف النص فعلى هذا إذا زنى رجل بامرأة فجاءت بولد فادعاه الزاني لم يثبت نسبه منه لانعدام الفراش (بدائع الصنائع ص242 ج6)
