Question:-
Is it permissible to make Tafweed of Talaaq to an institute such as a Darul ifta? If you state that you are giving the Ameer of the Darul Ifta the choice of issuing Talaaq, but if he passes away then the institute will give a suitable person the choice of issuing the Talaaq, then is it valid?
Answer:-
When making Tafweedh of Talaaq to a Darul Ifta then the common understanding is that the decision of executing the divorce is left to the discretion of the Ameer or head Mufti of the Darul Ifta. If the Ameer passes on, then the decision will be left to the next Ameer or head Mufti of the institute.
If you stipulate the name of a specific Mufti, then only the stipulated Mufti will be able to execute the Talaaq. Yes, if you state that after his demise, the right of issuing the Talaaq will pass over to Darul Ifta Ibn Masood (for example) then the Ameer of the institute will have the authority of issuing the divorce, or the Ameer will have the right of choosing whomsoever he wishes to execute the divorce if you state in your Tafweedh document that “Darul Ifta Ibn Masood has the power to choose whomsoever they wish to execute the Talaaq.”
تفویض کو کسی شرط کے ساتھ مشروط کرنے کی گنجائش شرعا موجود ہے ۔۔۔۔مذکورہ تفویض میں بھی عورت اور اجنبی شخص کا حکم برابر ہے ۔ جب اس کو اختیار دیا ہو ۔ (فتاوی عثمانی ص10 ج6)
