Taking responsibility for knocking a cat

QUESTION:

If a pet cat is knocked over and is need of treatment at the vet, on whom does the responsibility fall to tend to the cat? Would it be the owner of the cat, or the person who knocked it?

ANSWER:

If the car had knocked the cat, then the driver of the car will be responsible for the expenses incurred in treating it.

لا يضمن صاحب الدابّة التي أضرّت بيديها أو رجلها أو ذيلها حال كونها في ملكه راكبا كان أو لم يكن إلا إذا وطئت بيدها أو رجلها و هو راكبها فإنه يضمن لأن الإيطاء مباشرة لأن الإتلاف حصل بثقله (شرح المجلة 8/512)

لو داست دابّة مركونة لأحد على شيئ بيدها أو رجلها في ملكه أو في ملك الغير و أتلفته يُعدّ الراكب قد أتلف ذلك الشيئ مباشرة فيضمن على كل حال... و في المباشرة لا يشترط التعدي بخلاف الإيطاء فإنه تسبيب و فيه يشترط التعدي (شرح المجلة 8/516)
