QUESTION:
Please advise on the following extract:
When physically fit to walk, it is Waajib and imperative for Hajees / Mu’tamirs to perform Tawaaf walking. Those that used transport to perform Tawaaf in spite of being able to walk have omitted a Wajib, hence they should redo their Tawaaf, else penalties will be applicable. (Mu’allimul Hujjaaj)
ANSWER:
Yes, it is Waajib to perform Tawaaf and Sa’ee on foot. If a person without a valid excuse performs Tawaaf or Sa’ee whilst being carried, then it should be repeated while he is in Makkah Mukarramah. However, if he has returned home, then he will have to discharge Damm (have an animal slaughtered within the precincts of the Haram).
ولو طاف راكبا أو محمولا أو سعى بين الصفا والمروة راكبا أو محمولا إن كان ذلك من عذر يجوز ولا يلزمه شيء، وإن كان من غير عذر فما دام بمكة فإنه يعيد، وإذا رجع إلى أهله فإنه يريق لذلك دما عندنا كذا في المحيط.( الفتاوى الهندية 1/247)
