Niyyah Of Ihraam In Hadath-e-Akbar

QUESTION:

A lady traveling for Umrah becomes Paak en route to Makkah Mukarramah. Can she don her Ihraam in Abu Dhabi and make Niyyah before proceeding to Makkah Mukarramah, and perform Umrah after making Ghusl there?

ANSWER:

A person is not required to be in the state of purity when making the intention of Ihraam. As such, the woman in question will enter Ihraam in Abu Dhabi, and make Umrah after making Ghusl in Makkah Mukarramah. Crossing the Miqaat without Ihraam will necessitate either Damm (sacrificing an animal), or returning to the Miqaat and making Niyyah of Ihraam.

قال الحاكم الشهيد في الكافي المطبوع في الأصل (٢/٥١٨):

كل من أراد مكة لحاجة أو إحرام والوقت بينه وبينها فلا يجاوز الوقت إلا محرما.

وقال السمرقندي: ثم الآفاقي إذا جاوز الميقات بغير إحرام وهو يريد الحج أو العمرة ثم عاد إلى الميقات قبل أن يحرم فأحرم منه وجاوزه محرما، فإنه لا يجب عليه الدم لأنه قضى حقه بالإحرام، انتهى

و قال العلامة الشرنبلالي:

و يحرم بالحيض و النفاس ثمانية اشياء… و الطواف
