Incontinence Due To Old Age
Q1. Due to old age, my grandfather is unable to control his urine. His urine drips all the time. Would this qualify him as a Ma’zoor? When he sits, or even if he lies down, the urine drips down.
A1. In principle, if a person is unable to maintain his Wudhu for an entire Salaah time, to the extent that he can’t perform Wudhu and read Salaah, then such a person is classified as a Ma’zoor.
Q2. If he is considered Ma’zoor, what are the laws for a Ma’zoor?
A2. Rulings of Wudhu for a Ma’zoor:
a) A Ma’zoor must make a fresh Wudhu for every Fardh Salaah.
b) The Wudhu performed will be sufficient for all other Nafl acts of worship and teaching Quraan, etc. during that specific Salaah time.
c) The Wudhu will break with the expiry of each Salaah time, and a fresh Wudhu will need to be performed for the next Salaah time.
d) If any other causes which normally break Wudhu occur, the Wudhu will break (only the cause of becoming Ma’zoor will be excused, in this case, the emission of urine drops).
In the queried scenario, the phrase ‘his urine drips all the time’ is quite vague. However, due to the nature of your query, we assume you mean that he can’t make Wudhu and complete a Salaah without the mentioned discharge occurring. If this is your intended meaning, then he will qualify as a Ma’zoor and should follow the laws of a Ma’zoor as mentioned above.
Q3. We intend going for Umrah and would like to take him with us. However, he feels reluctant due his incontinence and is concerned about not have any protection under his Ihraam. What can he do to counteract this problem?
A3. He may wear an adult diaper while in Ihraam.
اگر ایک مرتبہ کسی نماز کا کامل وقت اس حالت میں گزر جائے کہ اخراج ریح مسلسل رہے یعنی اتنی دیر کے لئے بھی بند نہ ہو کہ وہ وضو کر کے وقتہ نماز پوری کر سکے تب تو یہ شخص معذور ہے ، اس کا حکم یہ ہے کہ ہر وقت کے لئے اس کے ذمہ وضو ضروری ہے اور اس وضو سے فرض نفل ادائے قضا جو دل چاہے پڑھتا رہے، خروج ریاح ناقض نہیں ہوگا ، وقت خارج ہونا اس کے حق میں ناقض وضو ہے، ہر وقت کے لئے علیحدہ وضو ضروری ہے اور یہ شخص معذور رہے گا جب تک کہ کسی ایک نماز کا کامل وقت عذر سے خالی نہ گزر جائے ، یعنی معذور رہنے کے لئے یہ ضروری نہیں کہ عذر مسلسل رہے، البتہ یہ ضروری ہے کہ ہر نماز کے کامل وقت میں ایک دو مرتبہ عذر کا تحقق ہو جائے ۔
اور جب ایسی حالت آجائے گی کہ کامل وقت ایک مرتبہ بھی عذر سے خالی گزر جائے گا تو شخص معذور نہ رہے گا اور اگر کسی کامل نماز کا وقت ایسا نہیں گزرا کہ اس کو عذر سے خالی رہ کر نماز کا ادا کرنا ممکن ہو، بلکہ اتنی گنجائش مل جاتی ہے کہ ہر وقت میں نماز بلا عذر ادا کر سکتا ہے تو یہ معذور نہیں ہے خروج ریاح اس کے حق میں ناقض وضو ہے، هكذا في الطحطاوی، ص : ٨٦(١) ۔ فقط واللہ اعلم (فتاوى محمودية (7/547

الجواب : آنت وغیرہ اُترنے کے عذر کی وجہ سے لنگوٹ باندھنا جائز ہے، اور بدوں عذر مکروہ ہے مگر اس پر کوئی جزاء واجب نہیں ، نیکر پہنا ہر حال نا جائز ہے، اور اس پر لبس محیط کی جزاء واجب ہے ، قال فی شرح التنوير فان زرره أو خلله او عقده اساء ولادم عليه، وفى الشامية وكذ الوشده بحبل ونحوه لشبهه حينئذ بالمخيط (رد المحتار 2/171 )
