Butchers Mismanagement Of Qurbani Meat

QUESTION:

What is the ruling on butchers mixing up or misplacing Qurbani meat?

ANSWER:

The butcher will be liable as the meat was in his safekeeping. If a person wishes, they can claim the monetary value from the butcher. In this case, they have to give the money away in Sadaqah-they may not keep or use it. They may also choose to forgive and overlook, in the hope that Allah Ta’ala will overlook their shortcomings.

ولو غصب أضحية مذبوحة ضمن قيمتها لأنه مال مملوك لغيره أخذ بغير إذنه وإذا أخذ المضحي قيمتها يتصدق بها لأنه بالتضمين ملكها منه فصار كأنه باعها منه وإذا باعها منه لزمه التصدق بقيمتها فكذا هذا ولا يجوز له أن يهبها لغيره
