Issuing Talaaq During Haidh

QUESTION:

A husband and wife came to an agreement after a year of separation that he would issue Talaaq on the 12/06. Her Haidh is usually due around 14th/15th of the month. On 10/06, she started spotting. If the husband issued the Talaaq on the 12/06, will this Haidh be counted as the first cycle out of the three?

ANSWER:

If the bleeding continued for more than 3 days, then this will be regarded as Haidh. Now, since this bleeding came prior to the date of Talaaq (i.e. 12 June), this bleeding cannot be considered as the 1st Haidh cycle of the Iddah.

(إذا طلق الرجل امرأته) المدخول بها سواء كان (طلاقاً بائناً أو رجعياً أو وقعت الفرقة بينهما بغير طلاق) كأن حرمت عليه بوجه من الوجوه السابقة: كتمكين ابن الزوج, ونحو ذلك مما يوجب الفرقة (وهي حرة) و (ممن تحيض فعدتها ثلاثة أقراء) كوامل من وقت الطلاق أو الفرقة, فلو طلقت في الحيض لم بعد من العدة, (والأقراء) هي (الحيض) عندنا, لأن الحيض معرف لبراءة الرحم, وهو المقصود
