Change in Tuhr habit

QUESTION:-

For a woman’s Habit (Aadat) in her pure (Tuhr) days to change, is it necessary for there to be correct bleeding (3 to 10 days) before and after the pure days?

ANSWER:-

After experiencing a proper Haidh between 3-10 days, the clean period (of 15 days or more) that follows is referred to as, Tuhr-e-Taam (a complete clean period). Females generally have a set number of days of Tuhr, the same way they generally have a set number of days for Haidh. However, the number of days of Tuhr can vary at times, just as the number of bleeding days could vary.

For a new Tuhr habit to be established, it is necessary that one experiences a Damm-e-Saheeh (bleeding between 3-10 days) and Tuhr-e-Saheeh (a proper clean period of 15 days or more). Let’s assume that a woman had a habit of 5 days Haidh, and 17 days Tuhr. Then she experienced 5 days Haidh and 20 days Tuhr. Immediately after this change, she bled continuously. According to Imaam Abu Hanifa Rahimahullah and Imaam Abu Yusuf Rahimahullah, since the 5 days Haidh and 20 days Tuhr has now become her new habit, she will be required to return to this habit in the case of continuous bleeding. However, according to Imaam Muhammad Rahimahullah, she will be required to return to her previous habit of 5 days Haidh and 17 days Tuhr.

On the other hand, if she experiences 5 days Haidh and 20 days Tuhr twice, then all the A’immah agree that a new habit has been established. In conclusion, Sheikhein (Imaam Abu Hanifa Rahimahullah and Imaam Yusuf Rahimahullah) are of the view that, if a proper bleeding and Tuhr was experienced once, then a habit will be established even though the Tuhr or Haidh after this habit happens to be Faasid; while according to Imaam Muhammad Rahimahullah, she must experience a proper Haidh and Tuhr habit twice, for a habit to be established.

والعادة تثبت بمرة واحدة في الحيض والنفاس هذا قول ابي يوسف وابي حنيفة أخر قال في المحيط وبه يفتي وفي موضع اخر وعليه الفتوي —-وانما الخلاف في المعتادة اذا رات ما يخالف عادتها مرة واحدة هل يصير ذلك المخالف عادة لها ام لا بد فيه من تكراره مرتين بيان ذلك لو كانت عادتها خمسة من اول الشهر فرات ستة فهي حيض اتفاقا لكن عندهما يصير ذلك عادة – فاذا استمر بها الدم في الشهر الثاني ترد الي اخر ما رات وعند محمد الي العادة القديمة —–وتنتقل كذلك أي بمرة واحدة في الحيض والنفاس دما او طهرا وفيه الخلاف المار—-(رسائل ابن عابدين ص80)
