Days Of Haidh
QUESTION:
A lady spotted her Haidh on Tuesday, 12 August. Thereafter, she saw nothing. Today (15 August) she started bleeding. Will she count her Haidh from Tuesday or from today?
ANSWER:
In principle, if a single bleeding (which was preceded by a minimum Tuhr period of fifteen days or more) was accompanied by a second bleeding within fifteen days of the first, then this will be regarded as continuous bleeding, even though outwardly she was pure. Now, we will have to assess her Haidh habit. For example, if her habit normally is seven days of bleeding, then this month we will count seven days since the first bleeding as Haidh. The rest of the days until the end of the second bleeding (within fifteen days) will be Istihaadha.
In the queried scenario, the lady will count the beginning of her Haidh from Tuesday (12 August), as it was accompanied by a second bleeding within fifteen days.

وَرَوَى أَبُو يُوسُفَ عَنْ أَبِي حَنِيفَةَ أَنَّ الطُّهْرَ الْمُتَخَلِّلَ بَيْنَ الدَّمَيْنِ إذَا كَانَ أَقَلَّ مِنْ خَمْسَةَ عَشَرَ يَوْمًا لَمْ يُفْصَلْ وَكَثِيرٌ مِنْ الْمُتَأَخِّرِينَ أَفْتَوْا بِهَذِهِ الرِّوَايَةِ؛ لِأَنَّهَا أَسْهَلُ عَلَى الْمُفْتِي وَالْمُسْتَفْتِي. كَذَا فِي التَّبْيِينِ وَهَكَذَا فِي الزَّاهِدِيِّ وَالْأَخْذُ بِهَذَا أَيْسَرُ كَذَا فِي الْهِدَايَةِ وَعَلَيْهِ اسْتَقَرَّ رَأْيُ الصَّدْرِ الشَّهِيدِ حُسَامِ الدِّينِ وَبِهِ يُفْتَى. كَذَا فِي الْمُحِيطِ.

إذَا كَانَ الطُّهْرُ خَمْسَةَ عَشَرَ يَوْمًا أَوْ أَكْثَرَ يُعْتَبَرُ فَاصِلًا فَيُجْعَلُ كُلُّ وَاحِدٍ مِنْ الدَّمَيْنِ أَوْ أَحَدِهِمَا بِانْفِرَادِهِ حَيْضًا حَسْبَ مَا أَمْكَنَ مِنْ ذَلِكَ هَكَذَا فِي الْمُحِيطِ. وَأَقَلُّ الطُّهْرِ خَمْسَةَ عَشَرَ يَوْمًا وَلَا غَايَةَ لِأَكْثَرِهِ إلَّا إذَا اُحْتِيجَ إلَى نَصْبِ الْعَادَةِ كَمَا إذَا بَلَغَتْ مُسْتَمِرَّةَ الدَّمِ فَيُقَدَّرُ حَيْضُهَا بِعَشَرَةِ أَيَّامٍ مِنْ كُلِّ شَهْرٍ وَبَاقِيهِ طُهْرٌ. هَكَذَا فِي الْهِدَايَةِ
