QUESTION:
Can a person delay putting on his Ihraam and pass the Meeqaat? Can he don his Ihraam in Jeddah?
ANSWER:
It is recorded in Fataawa Uthmaani that if one dons the Ihraam in Jeddah, then he will be sinful for doing so as he crossed over the Meeqaat without Ihraam. However, Damm will not be applicable. This is the view of Mufti Shafi Saheb Rahimahullah [Re:- Fataawa Uthmaani Pg.210 Vol.2]
However, other Muftis are of the view that the Ihraam should be worn before crossing the Meeqaat. If one delays wearing the Ihraam until Jeddah, then Damm will be applicable. [Jadeed Fiqhi Masaa’il Pg.239 Vol.1]
Hence, it is best to practice upon the cautious view and don the Ihraam before passing the Meeqaat. Yes, if a person intends Jeddah as his final destination (not Makkah Sharif), and even spends the night or a good few hours in Jeddah, and then intends Umrah from Jeddah, then one may don the Ihraam in Jeddah. [Aap Ke Masaa’il Aur Unka Hal Pg.325 Vol.5] It will be acceptable for an extremely elderly person who is Ma’zoor and experiencing difficulty, to act upon the concession.
