QUESTION:
A man was married, and when he performed Hajj with his wife, he added on a trip to Musjid Al Aqsa. He remarried and currently has two wives. The second wife now also wants to visit Aqsa after Hajj. What is the ruling here?
ANSWER:
There is no equality in travelling. It does not mean that if the husband travelled with the first wife to Aqsa, he is required to take the second wife to Aqsa as well. Furthermore, the travel with the first wife to Aqsa was before the second Nikah was enacted, hence it will not be considered. Equality between wives is in spending money, clothing and in nights only.
وَلَنْ تَسْتَطِيعُوا أَنْ تَعْدِلُوا بَيْنَ النِّساءِ وَلَوْ حَرَصْتُمْ تمام العدل أن يسوي بينهن بالقسمة والنفقة والتعهد والنظر والإقبال، والمكالمة والمفاكهة والجماع وغيرها، وهذا كله غير مستطاع للإنسان مهما كان حريصا في تحري ذلك، ولذلك فرض الله العدل في النفقة والكسوة والمبيت، ولم يفرض فيما سوى ذلك (الأساس في التفسير ص1195 ج2)
