Fasting and Haidh

QUESTION:

A woman was under the impression that beige discharge is regarded as Haidh. She saw beige for 10 days before Ramadhaan started. So she counted the 10 days of beige as Haidh. The first night of Ramadhaan at Maghrib time, she saw red blood. However, she continued performing Salaah and started fasting (from the first fast), considering the red to be Istihaadha. Her habit is 9 days Haidh.

Should she keep Qadha of the fasts which she observed while experiencing the red discharge, or must she fast the entire Ramadhaan again since she hadn’t taken a Ghusl after the red discharge ended?

ANSWER:

Beige is made up of a light-greyish, yellowish brown colour. The Kitaabs of Fiqh state that yellow and brown are amongst the colours of Haidh. Therefore, beige will be considered as the colours of Haidh. Hence, the 9 days in which beige colour blood was seen will be Haidh, and and the normal bleeding (after the days of Haidh) will be considered as Istihaadha. This will be the ruling based on the text of the jurists which we have quoted below:

وليست الصفرة والكدرة بعد العادة حيضاً… وأما الدليل على أن ما بعد الحيضة من الصفرة والكدرة ليس حيضاً: فهو قول أم عطية:كنا لا نعد الصفرة والكدرة بعد الطهر شيئاً (الفقه الإسلام وأدلته 1/613)

وما تراه المرأة من الحمرة والسواد، إجماعاً والصفرة والكدرة والتربية، على الأصح في أيام الحيض فهو حيض حتى ترى البياض الخالص (اللباب 1/47)

She will not have to keep any Qadha fast since she fasted while she was bleeding with the blood of Istihaadha. Neither will she have to keep Qadha of the fast after the blood stopped as Ghusl is not a condition for the validity of a fast. A woman may commence fasting whilst being in the state of Janaabat (impurity).
