QUESTION:
1. If an individual succumbs to his Nafs and has relations during Haidh – is Taubah sufficient?
2. Is it Fardh to give charity after the above sin. If yes, what is the stipulated amount?
3. If one is limited on finances will a verbal Taubah or any amount of Sadaqah suffice?
ANSWER:
To intentionally have relations during Haidh is a major sin. However, sincere Taubah and Istighfaar will suffice. Some of the Kitaabs of Fiqh state that it is Mustahab (not obligatory but preferable) to give one Dirham in charity if one was intimate with his wife at the beginning of Haidh, or half a Dirham if he was intimate at the end of Haidh.
وَيُنْدَبُ تَصَدُّقُهُ بِدِينَارٍ أَوْ نِصْفِهِ. وَمَصْرِفُهُ كَزَكَاةٍ وَهَلْ عَلَى الْمَرْأَةِ تَصَدُّقٌ؟ قَالَ فِي الضِّيَاءِ: الظَّاهِرُ لَا (رد المحتار ص219 ج1)
فَإِنْ جَامَعَهَا وَهُوَ عَالِمٌ بِالتَّحْرِيمِ فَلَيْسَ عَلَيْهِ إلَّا التَّوْبَةُ وَالِاسْتِغْفَارُ وَيُسْتَحَبُّ أَنْ يَتَصَدَّقَ بِدِينَارٍ أَوْ نِصْفِ دِينَارٍ. كَذَا فِي مُحِيطِ السَّرَخْسِيِّ. (الفتاوي الهندية ص39 ج1)
(وَ) وَطْؤُهَا (يَكْفُرُ مُسْتَحِلُّهُ) كَمَا جَزَمَ بِهِ غَيْرُ وَاحِدٍ، وَكَذَا مُسْتَحِلُّ وَطْءِ الدُّبُرِ عِنْدَ الْجُمْهُورِ مُجْتَبٍ (وَقِيلَ لَا) يَكْفُرُ فِي الْمَسْأَلَتَيْنِ، وَهُوَ الصَّحِيحُ خُلَاصَةٌ (وَعَلَيْهِ الْمُعَوَّلُ) ؛ لِأَنَّهُ حَرَامٌ لِغَيْرِهِ وَلِمَا يَجِيءُ فِي الْمُرْتَدِّ أَنَّهُ لَا يُفْتَى بِتَكْفِيرِ مُسْلِمٍ كَانَ فِي كُفْرِهِ خِلَافٌ، وَلَوْ رِوَايَةٌ ضَعِيفَةٌ، ثُمَّ هُوَ كَبِيرَةٌ لَوْ عَامِدًا مُخْتَارًا عَالِمًا بِالْحُرْمَةِ لَا جَاهِلًا أَوْ مُكْرَهًا أَوْ نَاسِيًا فَتَلْزَمُهُ التَّوْبَةُ؛ (الدر المختار ص297 ج1)
