Unknowingly being intimate during Haidh
Question:-
A woman takes a bath due to her Haidh terminating, and thereafter engages in relations with her husband. The next day she sees a slight colour discharge (a very small amount), because of which she repeats her Ghusl. Will the couple be sinful?
Answer:-
If a female has a fixed habit of 7 days Haidh (for example) and on termination of her Haidh (after the bleeding stops), she takes Ghusl and then engages in relations with her husband, then this will be in order. Thereafter, if she discovers blood after a day (on the 8th day) which is within the 10-day period of Haidh, it will be counted as Haidh, particularly if the change (from 7 days to 8 days) occurred after a 15-day clean period. Since, the husband and wife were not intentionally intimate during Haidh, but rather engaged in relations as they were convinced that the Haidh had terminated, there is hope that they will not be held accountable in the court of Allah. However, both parties should make Taubah as a precautionary measure.
وَإِذَا انْقَطَعَ دَمُ الْحَيْضِ لِأَقَلَّ مِنْ عَشَرَةِ أَيَّامٍ لَمْ يَجُزْ وَطْؤُهَا حَتَّى تَغْتَسِلَ أَوْ يَمْضِيَ عَلَيْهَا آخِرُ وَقْتِ الصَّلَاةِ الَّذِي يَسَعُ الِاغْتِسَالَ وَالتَّحْرِيمَةَ؛ لِأَنَّ الصَّلَاةَ إنَّمَا تَجِبُ عَلَيْهَا إذَا وَجَدَتْ مِنْ آخِرِ الْوَقْتِ هَذَا الْقَدْرَ. هَكَذَا فِي الزَّاهِدِيِّ. (الفتاوي الهندية ص39)
قال وإذا انقطع دم الحيض لأقل من عشرة أيام لم يحل وطؤها حتى تغتسل لأن الدم يدر تارة وينقطع أخرى فلا بد من الاغتسال ليترجح جانب الانقطاع ولو لم تغتسل ومضى عليها أدنى وقت الصلاة بقدر أن تقدر على الاغتسال والتحريمة حل وطؤها (الهداية ص31 ج1)
ثُمَّ هُوَ كَبِيرَةٌ لَوْ عَامِدًا مُخْتَارًا عَالِمًا بِالْحُرْمَةِ لَا جَاهِلًا أَوْ مُكْرَهًا أَوْ نَاسِيًا فَتَلْزَمُهُ التَّوْبَةُ (رد المحتار ص297 ج1)
