Miscellaneous Queries On Musaafir

Q1) I travelled from point A to point B at a distance of 400km and stayed there for a week. Thereafter I returned to a town that is 55km away from my home for a further 3-4 days. Am I still considered a Musaafir and do I read Qasr Salaah?

A1) In the queried scenario, you will read Qasr Salaah until you return home.

Q2) I own a house in a town wherein I no longer reside. Some of my belongings are stored in a room while the rest of the house is rented out. Am I a Musaafir when I visit this town which is 119km from my new residence?

A2) Fundamentally, if you have made intention that the home you are currently staying in is your Watane Asli (original place of residence) then you will perform full Salaah in the current town you reside in. Regarding your previous home, it will be regarded as your Watane Iqaamah (place of residence) due to your belongings being there. Hence, you will perform full Salaah. Yes, if you do not keep any belongings there and you no longer consider the previous town as your residence, then you will read Qasr (short) Salaah, as long as you don’t stay there for 15 days or more.

الـصـحيـح مــاذكر أنه يعتبر مجاوزة عمران المصر لا غير إلا إذا كان ثمة قرية أو قرى متصلة بربض المصر، فحينئذ تعتبر مجاوزة القرى…و كذا إذا عاد من سفره إلى مصره لم يتم، حتى يدخل العمران

كوطن الإقامة تبقى ببقاء الثقل وإن أقام بموضع آخر

ومن كان له وطن فانتقل عنه بكل أهله واستوطن غيره ثم سافر فدخل وطنه الأول الذي كان انتقل عنه لم يتم الصلاة من غير نية إقامة، لأنه لم يبق وطنا له. والأصل في ذلك: أن الوطن الأصلي يبطل بمثله دون السفر عنه ووطن الإقامة يبطل بمثله وبالسفر عنه. قيدنا الانتقال بكل الأهل لأنه إذا بقي له فيه أهل لم يبطل ويصير ذا وطنين (اللباب في شرح الكتاب ج.2/244)

 ومن كان له وطن فانتقل منه و استوطن غيلره ثم سافر ودخل وطنه الاول قصر لانه لم يبق وطنا له الا ترى أنه عليه الصلاة والسلام بعد الهجرة عد نفسه بمكة من المسافرين.(هداية 1/167)
