QUESTION:
If a Muqeem is reading Asr behind a Musaafir, what should the Muqeem read in the additional two Rakaats of the Salaah? And what would the ruling be if he only read Surah Fateha in the additional two Rakaats?
ANSWER:
The Muqeem should not recite any Surahs when completing his Salaah (in the last two Rakaats) after the Musaafir Imaam makes Salaam (after two Rakaats). The Muqeem follows the same ruling as a Laahiq (a person who joined the Imaam from the beginning of Salaah but his Wudhu was invalidated, so he had to renew his Wudhu and join the Jamaat again, or complete the remaining Rakaats on his own); meaning he will complete his Salaah without reciting anything. Similarly, the Muqeem follower does not recite in the remaining Rakaats when completing his Salaah.
However, if the Muqeem follower recites Surah Fateha in the last two Rakaats, it does not affect the validity of the Salaah nor does it necessitate Sajdah-e-Sahw, as some of the Fuqaha have stated that a Muqeem should recite when completing the remaining Rakaats.
ولا قراءة على المقتدى في بقية صلاته إذا كان مدركًا، أي لا يجب عليه لأنه شفع أخير في حقه ومن مشائخنا من قال ذكر فى الأصل ما يدل على وجوب القراءة فإنه قال : إذا سها يلزمه سجود السهو . (بدائع الصنائع ج١ ص٢٧٧(
إذا سلم المسافر أتم المقيم منفردًا لأنه التزم الموافقة فى الركعتين فصار كالمسبوق في التزام بعض الصلاة مع الإمام وأداء باقيها منفردًا فيقرأ :وقيل لايقرأ لأنه لاحق أدرك أول الصلاة. (شرح النقاية ج١ ص ٢٨٤)
