Question:-
What is the ruling if I pass the Miqaat by car in a state of Haidh?
Answer:-
You are required to pass the Meeqaat in a state of Ihraam if you intend proceeding to Makkah Sharif. If you passed the Meeqaat without Ihraam then a Damm will be applicable even though you may be in Haidh. However, if you return to the Meeqaat and re-enter in a state of Ihraam then the Damm will fall away. Since you are in Haidh, you are only required to make Niyyat of Ihraam and will not have to perform the Sunnah Salaah.
لا يجاوز أحد الميقات إلا محرما ، وكذلك لو أراد بمجاوزة هذه المواقيت دخول مكة لا يجوز له أن يجاوزها إلا محرما، سواء أراد بدخول مكة النسك من الحج أو العمرة أو التجارة أو حاجة أخرى عندنا، (بدائع الصنائع ص164 ج2)
من جاوز وقته غير محرم ثم احرم او لا فعليه العود الي وقت وان لم يعد فعليه دم (غنية الناسك ص30)
