QUESTION:
- If a lady is a Muqeem in Muzdalifa will she perform 2 or 4 Rakaats when joining Maghrib and Esha Salaah?
- Is there any penalty if one’s hair naturally falls from the head during Ihraam?
- Is there any penalty for scratching an itch in Ihraam?
ANSWER:
1. The Fuqaha have stated that the reason for shortening the Salaah in Arafaat, Muzdalifa and Mina is due to a person being a Musafir, hence the people of Makkah and others who are Muqeem should perform their Salaah in full. [Re: Fataawa Darul Uloom Zakariyya Vol:3 Pg:393-394]
قصر الصَّلَاة أهل مَكَّة بمنى وعرفات لانْتِفَاء مَسَافَة الْقصر. وَقَالَ الطَّحَاوِيّ: وَلَيْسَ الْحَج مُوجبا للقصر لِأَن أهل منى وعرفوَقَالَ أَكثر أهل الْعلم، مِنْهُم عَطاء وَالزهْرِيّ وَالثَّوْري والكوفيون وَأَبُو حنيفَة وَأَصْحَابه وَالشَّافِعِيّ وَأحمد وَأَبُو ثَوْر: لَا يات إِذا كَانُوا حجاجا أَتموا، وَلَيْسَ هُوَ مُتَعَلقا بالموضع، وَإِنَّمَا هُوَ مُتَعَلق بِالسَّفرِ، وَأهل مَكَّة مقيمون هُنَاكَ لَا يقصرون، وَلما كَانَ الْمُقِيم لَا يقصر لَو خرج إِلَى منى كَذَلِك الْحَاج (عمدة القاري ج٨ص١١٩).
2. If the hair fell off by itself, then there is no penalty unless one caused it to fall off.
لا يخفى ان الشعر إذا سقط بنفسه لا محظور فيه لاحتمال قلعه قبل احرامه وسقوطه بغير قلعه، و اذا سقط بفعل المحرم بان احس به و ادركه، فحينئذ يلزمه الجزاء (غنية الناسك ص٢٥٨)
3. If one scratches or itches the body resulting in hair falling off unintentionally, then one should discharge Sadaqah.
وإذا حك المحرم رأسه أو لحيته فانتثر منها شعر فعليه صدقة كذا في السراج الوهاج (فتاوي الهندية ج١ص٢٦٨)
