Receiving recurring commission

QUESTION:

My brother buys and sells cars. For a short while I was keeping a written record of it. I observed his method where people find the cars for him, and if he buys that car, the person receives a commission from that purchase.

I found a contact to buy cars from in Cape Town. I made a deal with my brother and we agreed for him to pay me R200 commission on every car that he ends up buying from them. My brother contacts them directly now, leaving me out of it.

My brother now feels that this method is incorrect and he would rather give the money to me as a gift instead of a commission. Is it permissible to make a deal in this way or is it incorrect?

ANSWER:

Yes, your brother is correct that you are not entitled to commission if you aren’t doing any work. The first time you introduced him to the seller, you were entitled to a commission. However, now that you are no longer carrying out any work, you are not entitled to receive a commission.

Notwithstanding the above, if he intends giving you a gift, then he is at liberty to do so. However, since this is a voluntary action, he is at liberty to retract at any stage.
