Requisites Of Khalwah Sahihah

QUESTION:

Is it considered as Khalwah Sahihah if a newlywed couple secludes themselves in a closed room inside a restaurant, with the risk of anyone entering and the possibility of hidden cameras in that room? Consummation of the marriage did not take place but the couple did engage in physical affection.

ANSWER:

“Khalwah Sahihah” refers to that private seclusion between a newly married couple in which they are able to have sexual intercourse and there is no Shar’i or physical barrier preventing it. However, in the above query, there was the possibility of others entering the room, or seeing, and notwithstanding the hidden cameras. Even though the husband and wife may have hugged and kissed, Khalwah Sahihah did not occur.

وَالْمَكَانُ الَّذِي تَصِحُّ فِيهِ الْخَلْوَةُ أَنْ يَكُونَا آمَنَيْنِ مِنْ اطِّلَاعِ الْغَيْرِ عَلَيْهِمَا بِغَيْرِ إذْنِهِمَا كَالدَّارِ وَالْبَيْتِ كَذَا فِي شَرْحِ الْجَامِعِ الصَّغِيرِ لِقَاضِي خَانْ… وَفِي الْبُيُوتَاتِ الثَّلَاثَةِ أَوْ الْأَرْبَعَةِ وَاحِدٌ بَعْدَ وَاحِدٍ إذَا خَلَا بِامْرَأَتِهِ فِي الْبَيْتِ الْقُصْوَى إنْ كَانَتْ الْأَبْوَابُ مَفْتُوحَةً مَنْ أَرَادَ أَنْ يَدْخُلَ عَلَيْهِمَا مِنْ غَيْرِ اسْتِئْذَانٍ لَا تَصِحُّ الْخَلْوَةُ وَكَذَا لَوْ خَلَا بِهَا فِي بَيْتٍ مِنْ دَارٍ وَلِلْبَيْتِ بَابٌ مَفْتُوحٌ فِي الدَّارِ إذَا أَرَادَ أَنْ يَدْخُلَ عَلَيْهِمَا غَيْرُهُمَا مِنْ الْمَحَارِمِ أَوْ الْأَجَانِبِ يَدْخُلُ, لَا تَصِحُّ الْخَلْوَةُ, كَذَا فِي فَتَاوَى قَاضِي خَانْ
