Satr between Mahrams and non-Mahrams

QUESTION:

1. What does Awrah/Satr mean?

2. What is the awrah for women in front of the following people:

a) Non-Mahram males

b) Mahram males

c) Muslim females (including sisters, mother, aunts etc)

d) Non-Muslim females (including domestic workers)

ANSWER:

1. In Arabic ‘Awrah’ or ‘Satr’ refers to that part of the body of both the male and the female which is necessary to conceal in terms of Shariah, logically, and that which one naturally covers or conceals.

عورة عربی میں مرد وعورت کے بدن کا وہ حصہ ہے جس کا چھپانا شرعا بھی فرض ہے اور عقلاً وطبعا بھی ۔ اردو و فارسی میں اسے ستر کہا جا تا ہے ۔ آزادعورت کا سارا )فتاوی عثمانيہ 10/86)

2a) A woman’s Satr is from head to toe in front of non-Mahrams, except the palms which may be exposed.

وللحرة ولو خنثى جميع بدنها حتى شعرها النازل في الأصح خلا الوجه والكفين فظهر الكف عورة على المذهب والقدمين على المعتمد وتمنع المرأة الشابة من كشف الوجه بين رجال لا لأنه عورة بل لخوف الفتنة كمسه وإن أمن الشهوة لأنه أغلظ (الدر المختار و حاشية ابن عابدين 1/407)

 b) A woman’s Satr in front of her Mahram is her entire body except her face, head (which includes the hair), neck, hands, forearms, shin and feet. However, if there is fear of inclination and desire from her Mahaarim, then exposing the above-mentioned parts of the body will not be permitted. Since, we are living in an era of Fitnah, one should exercise caution in this regard.

وأمام محارمها جميع جسدها غير الوجه والأطراف: وهي الرأس والعنق واليدان والرجلان، إلا أن يخشى لذة فيحرم ذلك لا لكونه عورة (الفقه الإسلام وأدلته 1/747)

وأما نظره إلى ذوات محارمه فنقول: يباح له أن ينظر منها إلى موضع زينتها الظاهرة والباطنة وهي الرأس والشعر والعنق والصدر والأذن والعضد والساعد والكف والساق والرجل والوجه (الفتاوى الهندية 5/328)

c + d) A woman’s Satr in front of other Muslim women is from her navel to below her knees, and in front of non-Muslim woman, her Satr is her entire body except her face, hands, feet.

والمرأة مع المرأة أو مع ذوي محارمها كالرجل مع الرجل: ترى ما عدا ما بين السرة والركبة (الفقه الإسلام وأدلته 1/747)

وتنظر المرأة من المرأة والرجل إلى ما ينظر الرجل من الرجل (الإختيار لتعليل المختار 4/154)

عورت کا عورت کو دیکھنے اور چونے کا حکم :

ایک مرد دوسرے مرد کے جن اعضا کو دیکھ اور چھوسکتا ہے، انہی اعضا کو ایک عورت دوسری عورت کا بھی دیکھ یا چھوسکتی ہے ، یعنی ناف سے گھٹنے تک ، بشرط یہ کہ شہوت کا شائبہ نہ ہو ۔)فتاوی عثمانيہ 10/84)
